Terms of Service

1. Acceptance of Terms
By accessing or using Zauthy's services, APIs, SDKs, dashboard, or any related products (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
2. Description of Services
Zauthy provides enterprise-grade authentication, identity verification (KYC), and fraud prevention services through APIs and SDKs. Our Services include user authentication (passwords, MFA, passkeys, social login, magic links), document verification, biometric checks, liveness detection, device fingerprinting, and related security tools.
3. Account Registration
To use the Services, you must create an account and provide accurate, complete information. You are responsible for maintaining the security of your account credentials, API keys, and webhook secrets. You must notify us immediately of any unauthorized access. Zauthy is not liable for losses resulting from unauthorized use of your account.
4. Acceptable Use
You agree not to:
- Use the Services for any unlawful purpose or in violation of any applicable laws or regulations
- Attempt to bypass, circumvent, or disable any security features of the Services
- Reverse engineer, decompile, or disassemble any part of the Services
- Use the Services to transmit malware, spam, or other harmful content
- Exceed your plan's usage limits or attempt to access features not included in your subscription
- Resell or redistribute the Services without written authorization
- Use the Services in a manner that could impair their performance or availability for other users
5. API Usage and Rate Limits
API access is subject to rate limits and usage quotas based on your subscription plan. Exceeding these limits may result in temporary throttling or suspension. You must implement proper error handling for rate limit responses (HTTP 429). API keys are confidential and must not be shared publicly or embedded in client-side code.
6. Data Processing and Privacy
Our collection and use of personal data is governed by our Privacy Policy. When you use our KYC and identity verification services, you are responsible for obtaining appropriate consent from your end users. You must provide clear notice to your users about how their data will be processed.
7. Billing and Payments
Paid plans are billed monthly or annually in advance. Prices are exclusive of taxes unless otherwise stated. You authorize us to charge your payment method for recurring subscription fees. Failure to pay may result in suspension or termination of your account. Refunds are provided at our discretion in accordance with applicable law.
8. Service Level Agreement
Zauthy targets 99.99% uptime for all paid plans. Scheduled maintenance windows will be communicated in advance. In the event of downtime exceeding our SLA commitments, eligible customers may request service credits as described in their subscription agreement.
9. Intellectual Property
Zauthy retains all rights, title, and interest in the Services, including all intellectual property rights. You retain ownership of your data and any applications you build using our APIs. We grant you a limited, non-exclusive, non-transferable license to use the Services in accordance with these Terms.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZAUTHY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO ZAUTHY IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
11. Termination
Either party may terminate these Terms at any time. You may cancel your account through the dashboard. We may suspend or terminate your access if you violate these Terms. Upon termination, your right to use the Services ceases immediately. We will retain your data for 30 days after termination, after which it will be permanently deleted.
12. Changes to Terms
We may update these Terms from time to time. Material changes will be communicated via email or through the dashboard at least 30 days before taking effect. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
